Bloom Terms of Use

These Terms of Use (“Terms”) are an agreement between you and Aether Creations LLC (“we”, “us”) about your use of the Bloom app for iPhone and iPad (“Bloom”). By accepting these Terms in Bloom, or by using Bloom, you agree to them. If you don’t agree, don’t use Bloom.

Our Privacy Policy explains how Bloom handles information, and is part of these Terms.

1. Who can use Bloom

  • Parents and caregivers. Bloom is meant to be set up by an adult, often a parent or caregiver, who may then use it together with a child. If you set up Bloom for a child, you accept these Terms on their behalf and are responsible for how they use it.
  • Adults and teens using Bloom for themselves. You must be old enough to accept these Terms where you live. If you are under that age, a parent or legal guardian must review and accept these Terms for you.
  • You must also meet the App Store’s requirements for downloading apps in your country or region, and must not be prohibited from receiving software under the laws of the United States or any other applicable country.

2. What Bloom is

Bloom helps people work through routines one step at a time. You build checklists of small steps, run them, earn gems for each step, and spend gems growing a garden. Bloom works without an account or sign-in, and stores what you enter on your device, as described in the Privacy Policy.

Bloom is not a medical, therapeutic or educational service. It is a general-purpose routine and motivation tool. It does not diagnose, treat or prevent any condition, including ADHD, autism or other developmental, learning or behavioral conditions, and it is not a substitute for advice from a doctor, therapist, teacher or other qualified professional. Bloom’s Learning Moments and other content are general information only. Talk to a qualified professional about any questions you have about your or your child’s health, development or behavior.

You are responsible for the routines you create and for supervising children while they use Bloom. Don’t use Bloom for steps that would be unsafe for the person doing them, and don’t rely on Bloom’s timers or reminders for anything where a missed or late alert could cause harm.

3. Your license to use Bloom

We grant you a limited, non-exclusive, non-transferable, revocable license to download and use Bloom for your personal, non-commercial use on any Apple-branded iPhone or iPad that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. Bloom may also be used by other accounts associated with you through Family Sharing.

You may not:

  • copy, modify, translate or create derivative works of Bloom, including its artwork, characters, garden species, decorations, sounds and text;
  • reverse engineer, decompile or disassemble Bloom, or try to derive its source code, except where the law expressly allows it despite this restriction;
  • rent, lease, lend, sell, redistribute or sublicense Bloom;
  • remove or alter any proprietary notices in Bloom;
  • try to unlock Bloom+ features without a valid subscription, or interfere with Bloom’s purchase, parental-gate or security features; or
  • use Bloom in any way that breaks the law.

4. Your content

Your profiles, checklists, steps, notes and history (“Your Content”) belong to you. Your Content is stored on your device, and we don’t receive it, so you don’t grant us any license to it.

You are responsible for keeping your own copy. Because Your Content is stored only on your device, it is lost if you delete Bloom, or if your device is lost, damaged or reset, unless you have a device backup (such as iCloud Backup). We can’t recover Your Content for you.

5. Bloom+ subscriptions

Bloom is free to download and use. Bloom+ is an optional auto-renewing subscription that unlocks more gardens, the full catalog of plants and decorations, and new ones as they are added. The free tier always includes checklists, runs, gems, diamonds, the gem jar, History and Learning Moments.

  • Purchases through Apple. Bloom+ is sold through the App Store and billed to your Apple Account. Apple’s terms, including the Apple Media Services Terms and Conditions, apply to your purchase. We never see or store your payment details.
  • Plans and prices. Bloom shows the available plans and their price in your local currency before you subscribe.
  • Automatic renewal. A subscription renews automatically at the end of each period, at the then-current price, unless you cancel at least 24 hours before the period ends. Your Apple Account is charged within 24 hours before each renewal.
  • Free trials. If a plan offers a free trial and you’re eligible, the subscription starts and you are charged when the trial ends, unless you cancel at least 24 hours before it ends. Apple allows one free trial per Apple Account.
  • Cancelling. You can cancel at any time from Manage Subscription in Bloom’s Settings tab, or in your device’s Settings under your Apple Account. Cancelling stops future renewals; Bloom+ stays active until the end of the period you’ve paid for.
  • Refunds. Refunds are handled by Apple under its policies. You can request one at reportaproblem.apple.com. We can’t issue refunds directly.
  • Price changes. If the price of your subscription changes, Apple will notify you in advance and, where required, ask for your consent before you’re charged the new price.
  • Family Sharing. If the purchaser shares their subscriptions through Family Sharing, members of their family group can use Bloom+ on their own devices.
  • When Bloom+ ends. Nothing your profiles planted or grew is taken away. Every garden stays visible. In the newest garden, everything already planted, Bloom+ plants included, can keep growing, and free items can be planted on empty spots. Older gardens become read-only until Bloom+ is active again, and starting a new garden needs Bloom+.
  • Changes to Bloom+. We may add, change or retire items and features included in Bloom+. An item that has been made free stays free.

6. Gems, diamonds and gardens

Gems, diamonds, garden plants and decorations are virtual items that exist only inside Bloom to motivate and celebrate progress. They have no monetary value, can’t be bought, sold, transferred or exchanged for money or anything else, and are stored on your device along with Your Content.

7. Our intellectual property

Bloom, including its software, design, artwork, characters, garden species and decorations, sounds, Learning Moments and text, is owned by Aether Creations LLC or its licensors and is protected by copyright, trademark and other laws. “Bloom”, “Bloom+” and their logos are our trademarks. These Terms give you no right to use them other than to use Bloom as permitted here. All rights not expressly granted are reserved.

8. Feedback

If you send us suggestions or feedback about Bloom, we may use them without any obligation to you.

9. Changes to Bloom

We may update, change, suspend or discontinue Bloom or any of its features at any time. Updates may be required to keep using Bloom or Bloom+. Since Bloom works on your device without our servers, Bloom generally keeps working without an internet connection, except for purchasing and restoring Bloom+.

10. Ending these Terms

You can stop using Bloom at any time by deleting it from your devices. Deleting Bloom does not cancel a Bloom+ subscription; cancel it as described in section 5.

Your license ends automatically if you break these Terms. When it ends, you must stop using Bloom and delete it. Sections 4, 6, 7 and 11 to 17 survive the end of these Terms.

11. Disclaimer of warranties

To the fullest extent permitted by law, Bloom is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We don’t warrant that Bloom will be uninterrupted or error-free, that reminders will be delivered on time, or that Your Content will not be lost.

Some places don’t allow certain warranties to be excluded, so some of these exclusions may not apply to you.

12. Limitation of liability

To the fullest extent permitted by law, neither we nor our members, employees or agents will be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, use or goodwill, arising from or related to Bloom or these Terms, even if we were told such damages were possible.

Our total liability for all claims arising from or related to Bloom or these Terms is limited to the greater of the amount you paid for Bloom+ in the 12 months before the claim arose, or US$50.

Nothing in these Terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, or for fraud, and nothing affects rights you have as a consumer that can’t be waived by contract.

13. Indemnity

To the extent permitted by law, you agree to defend and indemnify Aether Creations LLC and its members, employees and agents against claims, losses and expenses (including reasonable attorneys’ fees) arising from your misuse of Bloom or your breach of these Terms.

14. Apple

These Terms are between you and Aether Creations LLC only, not Apple Inc. (“Apple”). If you downloaded Bloom from the App Store:

  • Responsibility. We, not Apple, are solely responsible for Bloom and its content.
  • Maintenance and support. We, not Apple, are responsible for any maintenance and support of Bloom. Apple has no obligation to provide any maintenance or support for Bloom.
  • Warranty. If Bloom fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for Bloom to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to Bloom, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to a warranty are our responsibility, to the extent they are not disclaimed in these Terms.
  • Product claims. We, not Apple, are responsible for addressing any claims by you or a third party relating to Bloom or your possession or use of it, including product liability claims, claims that Bloom fails to conform to any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
  • Intellectual property claims. If a third party claims that Bloom or your possession and use of it infringes that third party’s intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement and discharge of that claim.
  • Legal compliance. You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  • Third-party terms. You must comply with any applicable third-party terms when using Bloom.
  • Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms, and once you accept them, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

If these Terms conflict with the Apple Media Services Terms and Conditions on how you may use Bloom, Apple’s Usage Rules control.

15. Governing law and disputes

These Terms are governed by the laws of the State of North Carolina, United States, without regard to its conflict-of-law rules. If you live in the European Union, the United Kingdom or another country that gives you the benefit of its consumer protection laws, you also keep the protection of the mandatory provisions of the law of the country where you live.

Before starting any legal proceeding, please contact us (section 17) and give us 30 days to try to resolve the issue informally. If it isn’t resolved, any dispute will be brought in the state or federal courts located in Wake County, North Carolina, and you and we consent to their jurisdiction, except that you may bring a claim in the courts where you live if your local law gives you that right.

16. General

  • Changes to these Terms. We may update these Terms. The version number and “Last updated” date above show when they last changed. If we make a material change, the Terms get a new version number, and Bloom shows them to you and asks you to accept them before you can keep using Bloom. If you don’t agree to the updated Terms, stop using Bloom. Earlier versions stay available on our website.
  • Entire agreement. These Terms and the Privacy Policy are the whole agreement between you and us about Bloom.
  • Severability. If any part of these Terms is found unenforceable, the rest stays in effect.
  • No waiver. If we don’t enforce a part of these Terms, that is not a waiver of our right to do so later.
  • Assignment. You may not transfer your rights under these Terms. We may transfer ours, for example as part of a merger or sale of the business.
  • Events beyond our control. We are not responsible for delays or failures caused by events beyond our reasonable control.
